Terms of Service

Terms of Service.

Last updated May 4, 2026

These terms govern your use of Tutora's website, courses, and tutoring services. By booking a consultation, purchasing a package, or otherwise using the service, you agree to them. If you don't agree, please don't use the service.

1. Parties and services

These terms are an agreement between Tutora LLC ("Tutora," "we," "us," "our") and you, the customer ("you," "the Client"). The services covered by this agreement (the "Services") are 1 on 1 online math tutoring delivered over video, the related preparation, planning, materials, and communication, and any add-ons explicitly listed at checkout. Anything not listed is not included. Any change to the scope of the Services that involves additional cost is only effective once we agree to it in writing.

2. Who can use Tutora

Tutoring is delivered to students of all K-12 ages. If the student is under 18, a parent or legal guardian must be the account holder, agree to these terms on the student's behalf, and be responsible for payment.

3. Your responsibilities

As the Client, you agree to:

  • Be truthful with us about your student's level, goals, and prior coursework.
  • Cooperate with the tutor and keep them reasonably informed of changes that affect the work.
  • Keep your contact information current so we can reach you about scheduling or billing.
  • Make timely payments as set out below.
  • Make sure the student does the work assigned between sessions, where applicable. Our money-back guarantee depends on it.

4. Booking and payment

You can purchase a single session, a 6-session package, or a 10-session package. The price for the chosen package is shown on each course page at the time of purchase and is payable in full upfront, in U.S. dollars, through Stripe. We don't offer installment plans, and Services begin only after payment has cleared. We don't see or store your full card number.

Sessions are scheduled directly with your tutor after the free consultation. Packages do not expire on a fixed timeline, but we recommend completing them within six months of purchase to maintain continuity with your tutor and keep momentum in the work.

5. Money-back guarantee and refunds

Our money-back guarantee is real, but it's also specific. It exists for one situation: a family completes a full package, the student did the work, and there is documented evidence that no academic progress was made. The terms below explain exactly what qualifies and what we need from you. Refund handling is governed by this section. There is no separate refund policy document.

5.1 Eligibility

The money-back guarantee applies only to our 6-session and 10-session packages. To be eligible for a refund, all of the following must be true:

  • Every session in the package was completed. Not five of six. Not eight of ten. Every session must have been attended and worked through with the tutor. Sessions cancelled with less than 24 hours notice, no-shows, and sessions cut short by the student count as not completed and disqualify the package from a refund.
  • All assigned homework was completed. Tutors assign work between sessions. If your student missed assignments, turned in incomplete work, or didn't engage with the practice materials, the package is not eligible. We can't guarantee progress for a student who didn't do the work.
  • No measurable academic improvement occurred. Any documented improvement, in grades, test scores, classroom participation, confidence noted by a teacher, or progress on the goals we set at intake, disqualifies the request. The guarantee is for students who saw no progress at all, not students who hoped for more progress than they got.
  • The request is submitted within 14 days of the final session in the package.

5.2 No refunds for unused or partial packages

We don't refund unused sessions. If you stop tutoring partway through a 6 or 10 session package, the remaining sessions stay credited to your account but are not refundable. Single-session purchases are non-refundable once booked. The guarantee is tied to completing a full package, not to how many sessions a family chose to use.

5.3 Documentation we require

The burden of demonstrating no progress is on the family making the claim. To evaluate a refund request, we require documented evidence covering both the period before tutoring began and the period during/after the package. At minimum, we ask for:

  • Report cards or progress reports from the grading period(s) immediately before tutoring started, and from the most recent grading period.
  • Recent test, quiz, or exam scores in the math course your student was tutored in, both before and during/after the package.
  • A note or email from the student's math teacher describing their current performance and whether they have observed any change during the tutoring period.
  • Records of homework completion for the assignments given by the Tutora tutor between sessions, where applicable.

We may request additional documentation during review, including samples of the student's work, communication logs with the tutor, or follow-up evidence from the school. Refund requests submitted without supporting documentation will not be evaluated.

By submitting a refund request, you authorize Tutora to contact the student's math teacher or school directly to verify claims about the student's performance and progress during the tutoring period. We will only reach out for the limited purpose of confirming the information you have provided. If we are unable to verify a claim through the school after reasonable effort, the request may be denied.

5.4 How to submit a request

All refund requests must be submitted through our contact form. Select "Refund request" from the subject dropdown. In your message, include:

  • The student's name and the parent email used at checkout.
  • The course and package purchased, and the date of the final session.
  • A specific description of why you believe no progress was made.
  • Confirmation that you can provide the documentation listed in 5.3. We'll reply with instructions on how to send it securely.

We don't process refund requests by phone, by direct email to a tutor, or outside the contact form. Submissions through the form are tracked, dated, and reviewed in order.

5.5 Review process

We review every request individually. Reviews typically take 10 to 15 business days from the date we receive the complete documentation. We may follow up with the tutor, request additional materials, or ask the family for clarification. A decision is final once issued, though we're happy to discuss the reasoning. Approved refunds are returned to the original payment method via Stripe within 5 to 10 business days of approval.

6. Cancellations and rescheduling

Cancellations and reschedules of individual upcoming sessions are not refund requests. You can cancel or reschedule a session at no charge with at least 24 hours of notice; the session simply moves on the calendar and stays credited to your package. Cancellations made with less than 24 hours notice, and no-shows, count as a delivered session and are not credited back.

7. Tutor re-matching

If your student doesn't click with their tutor, message us early and we'll re-match at no cost, with remaining sessions carried over. Re-matching is not a refund and isn't subject to Section 5. Concerns about fit are best raised within the first one or two sessions, not at the end of a package.

8. Conduct during sessions

Sessions should be a safe, focused environment for learning. Both students and tutors are expected to behave respectfully. Recording a session, in any format, requires the consent of both parties. We reserve the right to end a session, re-match a student with a different tutor, or terminate an account in cases of harassment, abusive behavior, sustained no-shows, or other conduct that disrupts the work.

9. Materials and intellectual property

Worksheets, study plans, mock exams, and other materials we provide are for the personal educational use of the student in your account. You can't redistribute, resell, post publicly, or share them with anyone outside the household without our written permission. Anything your student creates during a session, like notes or solutions, belongs to them.

10. Confidentiality

Tutors handle information about your student's academic performance, learning style, and family circumstances in the ordinary course of teaching. We treat that information confidentially and share it only with the people working on your student's case at Tutora. You agree to extend the same care to information your tutor shares with you about their methods, prepared materials, and internal processes. Both sides' confidentiality obligations survive termination of these terms.

11. Tutor relationships (non-solicitation and non-circumvention)

Tutora invests in finding, vetting, training, and supporting our tutors. While your account is active and for one year after your last session with a Tutora tutor, you agree that you will not, directly or indirectly:

  • Hire, attempt to hire, or solicit for tutoring or related services any person who is or was a Tutora tutor or contractor during the 12 months before that hiring or solicitation.
  • Arrange tutoring with a Tutora tutor outside the Tutora platform, by direct payment, by side arrangement, or otherwise, in a way that bypasses Tutora.
  • Encourage a Tutora tutor to leave Tutora or to provide services to you outside the Tutora platform.

If you want a tutor who has worked with your student to continue working with them in a different arrangement, talk to us first. The one-year period is paused for any time you are in breach of this section, while the breach is not yet known to us.

12. Privacy

Our Privacy Policy explains what information we collect, how we use it, and how we protect it. By using Tutora you agree to that policy.

13. Results and disclaimers

We work hard to help every student make real progress, and our money-back guarantee backs that promise on the terms set out in Section 5. We can't, however, guarantee any specific grade, test score, admissions outcome, or pace of improvement. Education depends on many factors, including how consistently your student attends, engages, and completes assigned work.

The Services are provided "as is." We don't warrant that the website or session software will always be uninterrupted or error-free. If a technical issue on our end disrupts a session, we'll reschedule it at no cost.

14. Limitation of liability

To the fullest extent allowed by law, Tutora and its directors, officers, agents, and employees are not liable for any special, indirect, punitive, consequential, or incidental damages arising from the Services or these terms, regardless of the theory of liability (contract, negligence, warranty, indemnification, tort, strict liability, or otherwise). Our total liability for any claim related to the Services is limited to the amount you paid us under this agreement in the 12 months before the claim arose.

You also release Tutora and its representatives from any claim for damages that are covered by your own insurance, to the extent of that coverage. Nothing in these terms limits liability that cannot legally be limited.

15. Indemnity

You and Tutora each agree to indemnify and hold the other harmless from third-party claims, expenses, losses, or damages that arise from the indemnifying party's negligent act or omission in connection with the Services. This is a mutual obligation: it applies in both directions.

16. Force majeure

If we cannot deliver the Services because of an event outside our reasonable control, including acts of God, natural disasters, epidemics, public health emergencies, internet or platform outages, government actions, war, civil unrest, or labor disputes, we're not in breach of these terms during that event. We will make commercially reasonable efforts to work around the issue (for example, by rescheduling sessions). If the disruption continues for more than 30 days, either of us may terminate the agreement, and we'll handle any unused sessions per Section 5.

17. Termination

You can stop using Tutora at any time. Either of us may end the agreement before Services begin without further obligation. Once Services have begun, refund and unused-session handling are governed by Section 5. If you materially breach these terms, Tutora may terminate the agreement immediately. The provisions on confidentiality, tutor relationships, intellectual property, limitation of liability, indemnity, dispute resolution, and governing law survive termination.

18. Dispute resolution

If a dispute arises out of or relates to these terms or the Services, both sides agree to first try to resolve it through good-faith negotiation. If that doesn't work after three attempts, the dispute will go to mediation under the applicable Massachusetts mediation rules. If mediation does not fully resolve the dispute, either side may bring the remaining issues to court. Claims that qualify for small claims court are exempt from the negotiation and mediation steps and may be filed there directly.

19. Governing law, venue, and attorney's fees

These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles. Any action to interpret or enforce these terms, or arising out of them, will be brought in the state or federal courts located in Massachusetts, and you and Tutora each consent to that jurisdiction. If Tutora has to bring legal action to enforce these terms, it may recover its reasonable attorney's fees and costs in addition to any other relief.

20. Reviews and public statements

You are free to share honest opinions about your experience with Tutora, including negative ones, in reviews and public discussion. You agree, however, not to make false or defamatory statements about Tutora, its tutors, or its staff, and not to misrepresent material facts about the Services. We hold ourselves to the same standard.

21. Changes to these terms

We may update these terms from time to time. When we do, we'll change the "Last updated" date at the top of the page. Material changes will be communicated by email to active customers. Continued use of the Services after a change means you accept the updated terms.

22. Entire agreement and general

These terms, together with the Privacy Policy, set out the entire agreement between you and Tutora about the Services and supersede any prior communications or agreements on the subject. Amendments must be in writing. If any provision is held invalid, illegal, or unenforceable, the rest stays in effect and is read to best reflect the original intent. Online and PDF signatures are as good as original signatures.
